Village President Craig Friend called the meeting to order at 7:00 P.M.
This was a regularly scheduled meeting of the Village of Mackinaw.
I. ROLL CALL
Present: 5 – Trustees Jesse Watkins, Tom Goings, Lynn Rudin, Mike DeChaney, and Jerry Peterson
Absent: 1 - Trustee Elmore
Also Present: Deputy Chief of Police Bob Davies, Attorney Mark McGrath, Attorney Pat McGrath, Village Clerk Austen Wood, Chief of Police Gary Hartzell, Village Treasurer Scott Eidenmiller, Carol and Patrick Haynes, and Public Works Manager Mike Schopp
II. PLEDGE OF ALLEGIANCE
III. CONSENT AGENDA: The consent agenda consists of approving the previous meeting minutes, recurring disbursements, and reports written by the Public Works Manager and Village Treasurer.
Trustee Peterson moved, seconded by Trustee Goings to approve all consent agenda items. On a roll call, the vote was:
AYES: 5 - Trustees DeChaney, Peterson, Watkins, Goings, and Rudin
NAYS: 0
ABSENT: 1- Trustee Elmore
There being five affirmative votes, the motion carried.
Trustee Elmore arrived 7:03 p.m.
IV. PUBLIC COMMENT:
Farmer’s Market- Carol and Patrick Haynes attended the meeting to continue discussion about a possible Farmer’s Market in Mackinaw. Carol Haynes and Village Clerk Austen Wood explained to the Board the insurance requirements to hold a Farmer’s Market. The Village may enroll in the Tulip Program provided by the IMLRMA which will allow participants to enroll in an insurance plan online, and lists the Village of Mackinaw as an additional insured. Village Clerk Austen Wood will follow up on finding out if this program will last for a whole season or just for a one to two-day event. More information will be provided at the next regularly scheduled meeting.
Carol Haynes also asked the Board if there was anything the Village could do to help out with advertising. Attorney Mark McGrath informed the Board and Carol that the Village cannot help advertise for a private for-profit event. President Friend suggested they could contact the Area Buyer’s Guide to add the Farmer’s Market to the Community Events section of the paper, and the Board advised her to talk to the Mackinaw Business Association to see what they may have to offer.
Carol and Patrick Haynes left the meeting at 7:06 p.m.
Angelica Gonzalez- Complaint- Gonzalez attended the meeting to discuss the ongoing problems with the Mackinaw Police Department and her neighbors. Gonzales reported multiple calls to the police in the last two years she has lived there. She admitted maintaining a burn pile on her property and complained that her neighbors are adding to her burn pile.

President Friend told Ms. Gonzalez that to the extent she has a complaint regarding the Village Police actions, the Village of Mackinaw cannot investigate its own police department, and she will need to call the State Police if she feels she is being harassed by the Police.
Angelica Gonzalez left the meeting at 7:16 p.m.
V. REPORTS:
A. CHIEF OF POLICE REPORT: Chief Hartzell informed the Board he has been off work for a week and a half, and during that time five or six notices were issued to homeowners. He will be checking on the status of these properties on April 19, 2010.
B. E.S.D.A. COORDINATOR REPORT: E.S.D.A. Coordinator Bob Davies informed the Board about two drug arrests made since the last Board meeting, and also reported on the activities in the Police Department.
C. VILLAGE TREASURER’S REPORT: Report on file.
Non-Recurring Disbursements- Trustee Goings moved, seconded by Trustee Watkins to approve the non-recurring disbursements. On a roll call the vote was:

Investment Report- Trustee Goings moved, seconded by Trustee Elmore to approve the Investment Report as submitted by Treasurer Eidenmiller. On a roll call the vote was:

PUBLIC WORKS MANAGER’S REPORT: Mike Schopp reported the Public Works Department has put in a new sign at Westwood Park which includes an American flag, and asked the Board for their opinion as to how they would like the sign to be lighted. Schopp also informed the Board bids for the sewer slip lining project will be going out next week, and he will be working on a sump pump ordinance to present to the Board in the future.
Lease Agreement with Cross Implement- Trustee Goings moved, seconded by Trustee Elmore to enter into the Lease Agreement with Cross Implement in the amount of $8100.00 and to authorize Village President Friend to sign the agreement. On a roll call the vote was:

D. CLERK’S REPORT:
Approval of Records Retention Policy- The Village Clerk presented a proposed Records Retention Policy. Trustee Peterson asked the Village Clerk to add a description of the application numbers referenced in the policy. This policy will be discussed further at the next regular Board meeting.
Executive Session Minutes – February 8, 2010- Trustee Goings moved, seconded by Trustee Rudin to table the approval of the February 8, 2010 minutes until the next regularly scheduled Board meeting. On a roll call the vote was:

Mack-ca-Fest Parade- Village Clerk Wood asked the Trustees who would be able to attend the parade this year. Trustees Peterson and Rudin may not be able to attend.
Census Ad- Trustee Peterson moved, seconded by Trustee Elmore to authorize the Clerk to advertise in the Area Buyer’s Guide to promote response rates for the Census. On a roll call the vote was:

Arbor Day Event- President Friend reminded the Board the Village has to stay compliant with this event in order to remain a member of Tree City USA. The Clerk is working with Eastside Educational Center on possible ideas for an event.
E. VILLAGE PRESIDENT’S REPORT:
Handling of F.O.I.A. Requests- President Friend recommended adjusting the protocol for handling F.O.I.A. responses. President Friend asked for the Board’s approval to have the F.O.I.A. Officer write up responses to F.O.I.A. requests, and to submit that draft to the Village Attorney to approve and make changes to those responses.
Trustee Elmore moved, seconded by Trustee DeChaney to accept President Friend’s recommendation to adjust F.O.I.A. response protocol and have the F.O.I.A. Officer write up responses to F.O.I.A. requests, and to submit that draft to the Village Attorney to approve and make changes to those responses. On a roll call the vote was:

Computer Server and Backup- President Friend informed the Board the computer server and back-up crashed two weeks ago, and a new hard drive as well as a new back-up device cost a total of $93.00.
Employee Compensation- The Board discussed a pay raise for full-time Public Works employee Brian Lang and asked Mike Schopp for his recommendation.
Trustee Goings moved, seconded by Trustee Watkins increase the hourly rate of pay for Brian Lang by one dollar, effective next pay period. On a roll call the vote was:

Employee Compensation Time Policy Ordinance- Trustee Goings moved, seconded by Trustee Elmore to approve Ordinance 804, an ordinance amending the Village of Mackinaw municipal code, said municipal code being Ordinance No. 513 of the Village of Mackinaw to provide amendments relating to compensatory time. On a roll call the vote was:
