MINUTES OF THE REGULAR MEETING OF THE ZONING BOARD OF APPEALS HELD AT THE MACKINAW MUNICIPAL BUILDING AT 7:30 P.M.
The meeting of the Zoning Board of Appeals was called to order at 7:30 p.m.
This was a regularly scheduled meeting.
I. ROLL CALL: Present: Board Members – Ted Laidig, Chuck Lowery, Steve Powell Sr., Todd Smith, Jesse Watkins and Wes Nunley
Absent: Chairman - Jerry Sweckard
Also Present: Recording Secretary Lisa Spencer, Zoning Officer Dallas Davis, Dave Robins and Paul Coovert
II. APPOINT ACTING CHAIRMAN: Smith moved, seconded by Laidig to appoint Wes Nunley as acting chairman for this regularly scheduled meeting only.

III. APPROVAL OF MINUTES: Regular Meeting – April 13, 2010
Smith moved, seconded by Watkins to approve the minutes of the regularly scheduled meeting of April 13, 2010 as submitted. motion carried.
IV. ZONING OFFICER’S REPORT: Zoning Officer, Dallas Davis presented the Board with a report of all building permits issued for 2010.
308 & 310 S Main St. - Davis spoke to the Board regarding 308 & 310 S Main St. Property owner Dave Robins is in the process on dividing the lot and constructing a duplex on the empty portion. This duplex would meet all zoning code requirements. The existing older home will have a side set back of four feet instead of the required ten feet stated in the current zoning code. Davis feels that this is not an issue since the older home is grandfathered in from before the Village had a zoning code. The Board agreed.
102 S Kruse St - An update was given regarding Richard Smith, tenant of 102 S Kruse St. Smith was operating a small engine repair business out of his garage. In 2009 this garage burned down so he is now running this business in his yard. Neighbors are complaining of the excessive noise and accumulation of small engines. Davis is working with Police Chief Hartzell to enforce the provisions of the Village Code.
Watkins moved, seconded by Smith to accept the Zoning Officer’s report as submitted. motion carried.

V. VARIANCE HEARING: A public hearing was held regarding the variance application submitted by Charles Michael Templeton Jr. of 7 Tiffany Ct. to exceed the size limitations of an accessory structure as stated in the Village code. Templeton would like to construct a 30’ x 34’ accessory structure to accommodate his show trucks. No members of the public attended this hearing.
Smith moved, seconded by Laidig to recommend to the Village Board to approve the variance application and grant this variance. On a roll call, the vote was:
AYES: 6 – Nunley, Powell, Smith, Watkins, Lowery & Laidig
NAYES: 0
ABSENT: 1 – Sweckard
There being six affirmative votes, the motion carried.
VI. SPECIAL USE HEARING: A public hearing was held regarding the special use permit application submitted by Paul Coovert of 605 S Orchard St. to allow three residential apartments on the ground level of the north end of his commercial zoned property. No members of the public attended this hearing.
Smith moved, seconded by Watkins to recommend to the Village to grant a special use permit to Coovert with the understanding that all requirements in Village Code section 153.071 are met. On a roll call, the vote was:
AYES: 6 – Nunley, Powell, Smith, Watkins, Lowery & Laidig
NAYES: 0
ABSENT: 1 – Sweckard
There being six affirmative votes, the motion carried.
VII. ADJOURNMENT @ 8:05 P.M.
There being no further business to come before the Board, Laidig moved, seconded by Lowery to adjourn. motion carried.
